World Wrestling Style is covered by the VAT exemption scheme for small businesses.
VAT not applicable under Article 293 B of the French General Tax Code.
World Wrestling Style is hereinafter referred to as the ‘Seller’.
References to the company's SIREN number and full registration details will be added once it has been registered.
Sales may be definitively carried out in the name of World Wrestling Style only once it has been registered.
Article 2 – Purpose and scope
These Terms and Conditions of Sale (hereinafter the ‘Terms’) set out the rights and obligations of the Seller and its customers in connection with online sales of products offered on the Site.
They apply to orders placed by any natural person acting for purposes outside their trade, business, craft, profession or agricultural activity (hereinafter the ‘Customer’).
These Terms are available on the Site at any time. Customers may view, download and print them before placing an order.
By confirming an order, the Customer acknowledges that they:
* have read these Terms;
* have the legal capacity to enter into a contract;
* accept the Terms without reservation.
The applicable Terms are those in force when the order is confirmed.
Article 3 – Products
The Site offers for sale, in particular:
* clothing and textiles;
* singlets and sportswear;
* footwear;
* accessories;
* sports equipment;
* collectable items;
* merchandise;
* products connected with professional wrestling, wrestling, combat sports and sports culture.
Each product has a description of its essential characteristics, price, sizes, colours, materials and, where relevant, customisation options.
The Customer must read this information before placing an order.
Product photographs, videos, illustrations and graphics are presented with great care. They are nevertheless illustrative and are not contractually binding.
Minor differences in colour or appearance may result from the screen used, lighting, printing or manufacturing processes. Such differences do not constitute a lack of conformity where they do not affect the product's stated essential characteristics.
Offers remain valid while displayed on the Site and subject to stock availability.
Article 4 – Customised products
Certain products may be made or customised according to the Customer's instructions.
Customisation may include:
* a surname;
* a first name;
* a nickname;
* a number;
* text;
* a logo;
* an image;
* a particular size;
* a design or combination of elements chosen by the Customer.
The Customer must carefully check customisation details before confirming the order.
Once an order has been confirmed and production has begun, changes cannot be guaranteed.
The Customer warrants that they hold all necessary rights and permissions for any text, images, logos, photographs, trade marks or other materials supplied to the Seller.
The Customer warrants that these materials do not infringe third-party rights, including intellectual property rights, image rights or privacy rights.
The Seller may refuse customisation containing material that is:
* unlawful;
* violent or threatening;
* discriminatory;
* defamatory;
* infringing;
* in breach of a third party's rights;
* contrary to public policy or accepted standards of decency.
Article 5 – Prices
Product prices are shown in euros.
As World Wrestling Style is covered by the VAT exemption scheme for small businesses, invoices and commercial documents include the statement:
‘VAT not applicable under Article 293 B of the French General Tax Code.’
Delivery costs are not included in the product price unless stated otherwise. They are shown to the Customer before the order is finally confirmed.
The Seller may change prices at any time. However, a product is charged at the price shown when the order is confirmed, unless there is an obvious error.
If there is an obvious pricing error, including one caused by a computer malfunction, the Seller informs the Customer promptly. The Customer may then confirm the order at the corrected price or request cancellation and a refund of amounts paid.
Article 6 – Orders
To place an order, the Customer must in particular:
1. select the desired product or products;
2. choose any options and customisation;
3. add the products to the basket;
4. check the basket contents and amount;
5. provide billing and delivery details;
6. choose an available delivery method;
7. read and accept these Terms;
8. check the order summary;
9. make payment.
Before final confirmation, the Customer may correct any errors.
The order becomes final after:
* payment has been confirmed;
* the Customer has received a confirmation email.
The confirmation email summarises the order's essential details, price, delivery costs and the Seller's contact details.
The Customer must provide accurate, complete and current information.
The Seller cannot be held responsible for a delay or failed delivery caused by an incorrect, incomplete or insufficiently precise address supplied by the Customer.
Article 7 – Refusal or cancellation of an order
The Seller may refuse or cancel an order for a legitimate reason, in particular:
* if a product is unavailable;
* if payment fails or is refused;
* if information is manifestly incorrect;
* if there is reasonable suspicion of fraud;
* if an order is unusual or clearly excessive;
* if there is an unresolved prior dispute with the Customer;
* if a customisation request is unlawful;
* if there is an obvious error concerning the product's price or characteristics.
If payment has already been collected and the Seller cancels the order, amounts paid are refunded promptly.
Article 8 – Payment
Payment is made through the secure Stripe payment service.
The payment methods actually available are shown at checkout.
The Customer warrants that they are authorised to use the chosen payment method.
Bank card details are processed directly by Stripe and are not retained by World Wrestling Style.
The Seller cannot be held responsible for an incident arising from the operation of the payment service, except where the Seller is directly at fault.
An order may be suspended or cancelled if the bank or payment provider refuses payment.
Article 9 – Product availability
Products are offered subject to stock availability.
If a product becomes unavailable after an order is placed, the Seller informs the Customer promptly.
Where possible, the Customer may then choose to:
* wait for the product to be restocked;
* accept an equivalent product;
* cancel the affected part of the order.
If cancelled, amounts paid for the unavailable product are refunded.
No replacement product will be sent without the Customer's prior agreement.
Article 10 – Delivery
Products are delivered to the address given by the Customer when placing the order.
Delivery areas, available carriers, prices and estimated times are shown on the Site or at checkout.
The usual estimated times are:
* in-stock products: two to five working days;
* customised products: ten to fifteen working days, depending on the customisation.
These times are estimates.
If an order contains several products, they may be dispatched separately.
Where the carrier's service permits, the Customer receives a tracking number or link.
Article 11 – Delivery delay
Delivery times shown on the Site are indicative. Unless otherwise stated at checkout, the delivery time for standard products is generally fourteen (15) working days from confirmation of the order.
If this period is exceeded, the Customer is encouraged to contact the Seller for information on the order's status.
Under the French Consumer Code, if the product has not been delivered by the end of this period, the Customer may formally require the Seller to deliver it within a reasonable additional period.
If delivery does not take place within that additional period, the Customer may terminate the contract under Articles L.216-6 et seq. of the French Consumer Code.
The Customer may, however, terminate the contract immediately if the Seller refuses to deliver or if the agreed delivery date or period was an essential condition of the order.
Article 12 – Transfer of risk
The risk of loss of or damage to a product passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of it.
If the Customer arranges delivery through a carrier they chose themselves and which was not offered by the Seller, risk passes when the product is handed to that carrier.
Article 13 – Receipt of the parcel
On receipt, the Customer is encouraged to check:
* the condition of the packaging;
* the number of products received;
* the products' apparent condition;
* that the products match the order.
If a parcel is visibly damaged, open or incomplete, the Customer is encouraged to make specific reservations with the carrier and promptly inform the Seller.
The absence of reservations does not deprive the Customer of statutory warranties.
Any complaint may be sent to:
Worldwrestlingstyle.fr@gmail.com
The Customer must provide their order number and, where useful, photographs of the parcel and product.
Article 14 – Right of withdrawal
Subject to statutory exceptions, the Customer has fourteen days from receipt of the product to exercise the right of withdrawal without giving a reason.
Where several products ordered together are delivered separately, this period begins on receipt of the last product.
The Customer informs the Seller of their decision using:
* the withdrawal form at the end of these Terms;
* or any unambiguous statement expressing the wish to withdraw.
The request may be sent to:
Worldwrestlingstyle.fr@gmail.com
The Customer must then return the product without undue delay and no later than fourteen days after communicating the decision to withdraw.
Returns must be sent to:
World Wrestling Style
15 rue Alphonse Daudet
63100 Clermont-Ferrand
France
The Customer bears the direct cost of return unless:
* the Seller agrees to pay it;
* the product is non-conforming or defective;
The Customer may handle the product to the extent necessary to establish its nature, characteristics and proper functioning.
The Customer may be liable for any loss in value resulting from handling beyond what would reasonably be permitted when trying on an item in a shop.
Article 15 – Exceptions to the right of withdrawal
Under the French Consumer Code, the right of withdrawal may in particular not be exercised for products:
* made to the Customer's specifications;
* clearly personalised.
This exception may apply in particular to a product made or printed specifically at the Customer's request with a name, number, text, logo, image, special size or personal design.
Simply choosing among standard options offered to all customers does not necessarily remove the Customer's right of withdrawal.
The Customer is informed before ordering when a product is excluded from the right of withdrawal because it is personalised.
Article 16 – Refunds following withdrawal
In the event of valid withdrawal, the Seller refunds all amounts paid for returned products, including the standard delivery costs originally charged.
Additional costs arising from the choice of a delivery method more expensive than the standard delivery offered are not refunded.
The refund is made no later than fourteen days after the Seller is informed of the decision to withdraw.
The Seller may delay the refund until:
* the product is received back;
* or the Customer supplies proof that it was sent back,
whichever occurs first.
The refund is made using the same payment method as the original order, unless the Customer expressly agrees to another method that incurs no fees.
Article 17 – Goodwill exchanges
Outside the right of withdrawal and statutory warranties, there is no automatic right to an exchange.
The Seller may nevertheless agree, as a goodwill gesture, to exchange a size, colour or model.
The conditions of such an exchange are communicated to the Customer.
Agreeing to a goodwill exchange does not mean that the Seller waives these Terms for other orders.
Article 18 – Statutory warranty of conformity
The Customer benefits from the statutory warranty of conformity under Articles L. 217-3 et seq. of the French Consumer Code.
The Seller is responsible for any lack of conformity existing when the product is delivered and appearing within the statutory period.
If a product does not conform, the Customer may request repair or replacement, subject to the statutory conditions concerning cost and feasibility.
If repair or replacement is impossible, is not carried out as required by law, or causes major inconvenience, the Customer may request a price reduction or termination of the contract under the conditions laid down by law.
The Customer does not have to prove that the lack of conformity existed during the presumption period provided by applicable law.
Article 19 – Warranty against hidden defects
The Customer also benefits from the warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code.
This warranty applies where a hidden defect makes the product unfit for its intended use or so reduces that use that the Customer would not have bought it, or would have paid less for it, had the defect been known.
The Customer may choose between:
* returning the product for a refund of its price;
* keeping the product in exchange for the creation of a new product.
A claim must be brought within the statutory period from discovery of the defect.
Article 20 – Making a warranty claim
To make a warranty claim, the Customer must contact:
Worldwrestlingstyle.fr@gmail.com
The Customer is encouraged to provide:
* the order number;
* an accurate description of the problem;
* any useful photographs or video;
* the date on which the defect was discovered.
The exercise of a statutory warranty cannot be made conditional on supplying the original packaging where it is not needed to process the claim.
Where a defect is covered by a statutory warranty, the costs necessary to bring the product into conformity are borne by the Seller as provided by law.
Article 21 – Liability
The Seller is responsible for proper performance of the obligations arising from a distance contract, as provided by law.
The Seller cannot, however, be held responsible where non-performance or poor performance results from:
* an act of the Customer;
* the unforeseeable and unavoidable act of a third party to the contract;
* a force majeure event.
The Seller is not responsible for damage resulting from:
* use of the product contrary to its intended purpose;
* failure to follow care instructions;
* a change made to the product by the Customer;
* normal wear and tear;
* damage caused after delivery.
No limitation of liability in these Terms may deprive the Customer of mandatory rights granted by law.
Article 22 – Force majeure
Neither party may be held responsible for failure arising from an event meeting the conditions for force majeure under French law.
The affected party informs the other party promptly.
Where the impediment is temporary, performance of the obligation is suspended unless the delay justifies termination of the contract.
Where the impediment is permanent, the contract may be terminated as provided by law.
Article 23 – Intellectual property
The World Wrestling Style name, the Site, and its texts, graphics, creations, photographs, videos, logos, illustrations, databases, presentations, designs and other content are protected by intellectual property law.
Unless stated otherwise, they belong to World Wrestling Style or are used with their owners' permission.
Any unauthorised reproduction, display, adaptation, extraction, distribution or use, in whole or in part, is prohibited.
Buying a product does not transfer to the Customer any intellectual property rights in the associated creations, visuals or content.
In particular, the Customer may not reproduce products or their designs for commercial purposes without prior written permission.
Article 24 – Personal data
Personal data collected in connection with orders is processed in accordance with the Privacy Policy available on the Site.
In particular, it may be used to:
* process the order;
* manage payment;
* arrange delivery;
* respond to the Customer's enquiries;
* manage returns and warranties;
* prevent fraud;
* comply with accounting and legal obligations.
The Customer has the rights provided by applicable personal data protection law.
They may exercise these rights by writing to:
Worldwrestlingstyle.fr@gmail.com
Article 25 – Evidence and archiving
Computerised records kept under reasonable security conditions are evidence of communications, orders and payments between the parties.
Invoices are archived on a reliable, durable medium for the period required by law.
The Customer is encouraged to keep the confirmation email and a copy of the Terms applicable to the order.
Article 26 – Customer service and complaints
For any enquiry, the Customer may contact customer service:
Email: Worldwrestlingstyle.fr@gmail.com
Telephone: 07 43 63 35 42
Postal address:
World Wrestling Style
15 rue Alphonse Daudet
63100 Clermont-Ferrand
France
The Customer is encouraged to provide the order number to make the enquiry easier to process.
Article 27 – Consumer mediation
If a problem arises, the Customer must first send a written complaint to the Seller so that an amicable solution can be sought.
If no amicable solution is reached, the consumer Customer may refer the matter free of charge to the consumer mediator to which World Wrestling Style belongs, under Articles L. 612-1 et seq. of the French Consumer Code.
The contact details of the mediator chosen by World Wrestling Style will be included in these Terms and on the Site once the company has joined a mediation scheme.
The company must join the scheme and add the mediator's contact details before the Site is definitively opened for orders.
Article 28 – Governing law and competent courts
These Terms and contracts concluded under them are governed by French law.
In the event of a dispute, the parties will first seek an amicable solution.
If no agreement is reached, the consumer Customer may bring the matter before the competent court under the French Code of Civil Procedure and Consumer Code.
Nothing in these Terms deprives the Customer of the right to bring proceedings before courts having territorial jurisdiction under consumer protection rules.
Where a Customer lives in another European Union Member State, they also retain the benefit of any applicable mandatory consumer protection provisions of their country of residence.
Article 29 – Severability
If a provision of these Terms is declared void, unlawful or unenforceable, the other provisions remain in force.
Where possible, the affected provision is replaced by a valid provision with a comparable economic and legal effect.
Article 30 – Changes to the Terms
The Seller may change these Terms at any time.
New Terms apply only to orders placed after they take effect.
Earlier orders remain governed by the version accepted by the Customer when the order was confirmed.
